EPA prosecutes Offaly County Council

On 28 September 2005 the Environmental Protection Agency prosecuted Offaly County Council at Tullamore District Court.  The Council pleaded guilty to:

•  Failing to put in place the infrastructure necessary for the collection, handling and management of both landfill gas and leachate.

• Failing to prevent leachate discharging to surface waters.

• Failing to monitor levels of both leachate and the quality of surface water within the vicinity of its landfill facility at Derryclure.

On hearing details of the offences, Judge Neilan imposed fines totalling €2,500 and the EPA’s costs of €5,293 were also awarded.
