Wyeth Medica Ireland Limited Prosecuted on Indictment

On the 2nd June 2010, at Dublin Circuit Court, AHP Manufacturing Technology Limited t/a Wyeth Medica Ireland Limited pleaded guilty to offences under Sections 8, 9(1) (b) and 84(2) of the Environmental Protection Agency Act, 1992 for breaches of its Integrated Pollution Prevention Control Licence, Reg. No. PO153-02.

On the same date AHP Manufacturing Technology Limited t/a Wyeth Medica Ireland Limited pleaded guilty to offences under Article 6 (1) and 8 of the Waste Management (Transfrontier Shipment) Regulations 1998 and Section 10 (1) (b) and Section 36 of the Waste Management Act, 1996 and Article 5(1) (a) of the Waste Management (Movement of Hazardous Waste) Regulations 1998.

The case was listed for sentencing in Dublin Circuit Court on the 18th October 2010. 

The company admitted breaching conditions of its IPPC licence by disposing of or recovering waste material, namely rinse waters containing active ingredients namely Medroxyprogesterone acetate (MPA), by means of Cara Environmental Technology Limited (who is not an agreed hazardous waste contractor) and without the prior written agreement of the Environmental Protection Agency, contrary to Condition 7(1) and Schedule 3(i) of the Integrated Pollution Control Revised Licence, Reg. No. PO153-02 on the 18th day of September 2000 and the 28th day of November 2001.

The company admitted breaching  the Waste Management (Transfrontier Shipment) Regulations 1998 by shipping waste, namely rinse waters containing active ingredients namely Medroxyprogesterone acetate (MPA), out of the state without a certificate on the 26th April 2001. 

The company admitted breaching the Waste Management(Movement of Hazardous Waste) Regulations 1998 and the Waste Management Act, 1996 by, being the consignors of waste in the course of transferring hazardous waste to another person, who engaged an agent, Cara Environmental Technology Limited as a broker, who mixed together hazardous with non-hazardous waste on 15th May 2001.

Judge Patricia Ryan heard details of the offences on the 28th July 2010 and on the 18th October imposed a fine of €40,000.  AHP Manufacturing Technology Limited t/a Wyeth Medica Ireland Limited made a voluntary contribution of €70,000 towards costs.

AHP Manufacturing Technology Limited t/a Wyeth Medica Ireland Limited was granted IPPC Licence Reg. No. PO153-02 on the 27th March 1998 to carry on a Class 12.2.0 activity  - the manufacturing or use of coating materials at Buckleys Crossroads, Old Connell, Newbridge, Co Kildare.

This prosecution was taken following a six month investigation undertaken by An Garda Siochana and EPA Inspectors.  Due to the serious nature of the offences this case was referred to the Director of Public Prosecutions for prosecution on indictment.
