EPA prosecutes Kildare Chilling Company (P0170-01)

On 6th of March 2017 the Environmental Protection Agency prosecuted Kildare Chilling Company & Director at The Courthouse, Naas, Co. Kildare.

The company pleaded guilty to:

  • On the 1st of October 2015, failure to comply with Condition 6.1 in that emissions to sewer at emission point reference number SE1 exceeded the emission limit values for Total Ammonia and Orthophosphate set out in Schedule 1(i) of the said Licence.
  • On the 6th of October 2015, failure to comply with Condition 6.1 in that emissions to sewer at emission point reference number SE1 exceeded the emission limit values for Total Ammonia, BOD and Suspended Solids set out in Schedule 1(i) of the said Licence.
  • From the 8th of October 2015 to 23rd of October 2015, failure to comply with Condition 6.1 in that emissions to sewer at emission point reference number SE1 exceeded the emission limit values for Total Ammonia, BOD, Suspended Solids and Orthophosphate set out in Schedule 1(i) of the said Licence.
  • From the 7th of September 2015 to 30th of September 2015, failure to comply with condition 5.6, in that they failed to ensure that all operations on-site were carried out in a manner such that odours did not result in significant impairment of, or significant interference with amenities or the environment beyond the site boundary.
  • On the 12th of February 2016, failure to comply with condition 5.6, in that they failed to ensure that all operations on-site were carried out in a manner such that odours did not result in significant impairment of, or significant interference with amenities or the environment beyond the site boundary.
    On the 6th of October 2015, failure to comply with condition 9.1.1, in that they failed to ensure that only uncontaminated surface water run-off was discharged to the on-site surface water drainage system.

The director pleaded guilty to:

    On the 6th of October 2015, failure to comply with Condition 6.1 in that emissions to sewer at emission point reference number SE1 exceeded the emission limit values for Total Ammonia, BOD and Suspended Solids set out in Schedule 1(i) of the said Licence.

    On the 12th of February 2016, failure to ensure that all operations on-site were carried out in a manner such that odours did not result in significant impairment of, or significant interference with amenities or the environment beyond the site boundary.

On hearing details of the offence Judge Keane gave the Director the benefit of the Probation Act.  The Company was convicted on all of the charges and  imposed fines of  €11,250.

Agency costs were also awarded.
