EPA Prosecutes Offaly County Council

On the 28th September 2005 at Tullamore District Court, Co Offaly, Offaly County Council pleaded guilty to offences under Sections 39(1) and 39(9) of the Waste Management Acts 1996 and 2003 for breaches of its Waste Licence (Reg. No. 29-2).

The Council admitted breaching conditions of its Waste Licence by failing to put in place the infrastructure necessary for the collection, handling and management of both landfill gas and leachate.  It also failed to prevent leachate discharging to surface waters and to monitor levels of both leachate and the quality of surface water within the vicinity of its landfill facility at Derryclure.  The absence of this infrastructure has led to high production of methane gas and a negative impact on surface water and ground water in the surrounding area.

On hearing details of the offences, Judge Neilan imposed fines totalling €2,500 and the EPA’s costs of €5,293 were also awarded.

This prosecution was taken following two site inspections undertaken by the Office of Environmental Enforcement on 21st June 2004 and 27th October 2004, respectively.
