The Department has examined the submissions received from EPA and the Minister has agreed that no changes to existing Government policy on the NAP is to be made on foot of these submissions.
 
The Minister has also noted that, in relation to the Government Decision of March 2006 conveyed to the EPA on 10 April 2006, which approved the provision of up to 10% of the total allocation to new entrants and the cancellation of any allowances unused for this purposes at the end of the period, 'cancellation' is interpreted by the EPA to mean 'retirement' so as to ensure consistency between the rules governing accounting for allowances in the Registries Regulation and the intent of the Government Decision of March 2006.

We have examined the 20 submissions received in our recent public consultation which closed on Wednesday. Three matters relevant to your Department have been identified by us as follows:

1. Concerning the Total Amount                  Raised in Submissions from: IBEC; Grian; Bord na Mona
2. Concerning fate of unused allowances         Raised in Submissions from: Irish Cement; Synergen; Glanbia and Bord na Mona

3. Concerning Government Purchases              Raised in Submissions from:  IBEC; Grian

I attach copies of the all the submissions (including the above) and request your observations/response to the issues raised. In particular please let me know what changes, if any, you would wish to convey to the EPA on foot of these issues. If possible we would hope for an indicative response by Friday 17 November, though a little longer is possible if you require the additional time.

Please note that EPA will deal with all the remaining issues which have been raised in the submissions.
