EPA Prosecutes South East Recycling Company Ltd.

On the 10th April 2006 at Wexford District Court, The Environmental Protection Agency took a prosecution against South East Recycling Company Limited in relation to offences under Sections 39(1) and 39(9) of the Waste Management Acts 1996 - 2003 for breaches of its Waste Licence Reg. No. 111-1.

South East Recycling Company Limited pleaded guilty to four charges namely exceeding their annual waste tonnage limit for 2005 as set out in their licence. The company also pleaded guilty to accepting municipal waste which was not authorised by their licence and also transferring waste to an off-site facility which was not agreed by the EPA. The company was further charged in relation to accepting waste outside the licensed hours of operation.

On hearing details of the offences from an EPA inspector, Judge O’Buachalla imposed fines totalling €8,500 and the EPA’s costs of €5,000 were also awarded.

South East Recycling Company Limited was granted a waste licence (Reg. No. 111-1) on 24th January 2001 for the operation of a waste transfer station and recycling facility at Carrigbawn, Pembrokestown, Wexford.

This prosecution was taken following an audit carried out by the Office of Environmental Enforcement on 8th August 2005, and a site visit carried out on 27th October 2005.

South East Recycling Company Limited was previously prosecuted by the EPA on 6 December 2004 for breaches of its waste licence.
