EPA Prosecutes Marley Compost Limited
On the 24th July 2007 at Monaghan District Court, the Environmental Protection Agency took a prosecution against Marley Compost Limited in relation to offences under Sections 39(1) and 39(9) of the Waste Management Acts, 1996 - 2005 for a breach of its Waste Licence (Reg. No. W0118-01).
The company pleaded guilty to five charges all of which related to its failure to provide infrastructure for the control of odours within the timeframes required by the licence.
On hearing details of the offences Judge Sean McBride imposed fines of €2,500 and EPA costs of €7,859 were also awarded.
Marley Compost Limited was granted a Waste licence (Reg.No. W0118-01) on 8th August 2003 for the production of mushroom compost. The facility is located at Crush, Carrickroe, Co Monaghan.
This prosecution was taken following investigations undertaken by the Office of Environmental Enforcement on 16th May 2006 and the 3rd October 2006 respectively. The company has since ceased trading.
