EPA Prosecutes Cavan County Council

On the 27th of September 2007 at Cavan District Court, the Environmental Protection Agency took a prosecution against Cavan County Council for the operation of their Landfill at Corranure, in relation to offences under Sections 39(1) and 39(9) of the Waste Management Acts 1996 – 2005 for a breach of its Waste Licence (Reg. No. W0077-02).

The Council pleaded guilty to three charges, causing odour nuisance in the immediate area of the facility, failing to provide and maintain leachate and surface water management infrastructure, and failing to provide and maintain landfill gas infrastructure at the facility.

On hearing evidence from both an EPA inspector and some local residents, Judge McBride imposed fines of €4,500 and awarded EPA costs of €21,500.

The Council was granted a Waste Licence (Reg. No. W0077-02) on the 10th of May 2005 for the operation of a Landfill for non-hazardous waste.  The facility is located at Lismagratty and Corranure Townlands, Cootehill Road, Cavan.

This prosecution was taken following investigations undertaken by the Office of Environmental Enforcement with the assistance of local residents between 31st August 2006 to 14th February 2007.
