EPA Prosecutes Ray Whelan Limited
On the 6th of March 2008 at Carlow District Court, Ray Whelan Limited pleaded guilty to a charge brought by the Environmental Protection Agency in relation to offences under Sections 39(1) and 39(9) of the Waste Management Acts, 1996 – 2005 for breach of its Waste Licence (Reg. No. W0158-01)
The Company admitted breaching conditions of its licence by failing to install required infrastructure within specific timeframes and failing to submit a report to the EPA.
On hearing details of the offences from an EPA Inspector, Judge William Harnett imposed a fine of €1,500 and EPA costs of €7,320 were also awarded.
Ray Whelan Limited was granted a Waste Licence (Reg. No. W0158-01) on the 8th day of July 2003 for waste disposal activities and waste recovery activities. The facility is located at Cappanboe, County Laois.
The Office of Environmental Enforcement took this prosecution following an audit of the facility on 27th April 2006.
