These Regulations prohibit the placing on the market, sale or distribution of bituminous coal for residential use within the State unless;
Under the EPA Act, 1992, (Registration of Coal Bagging Operators and Fuel Suppliers) Regulations, 2011 the EPA is required to establish and maintain a register for each Coal Bagger Operator who supplies bagged bituminous coal for use in the Irish residential market. The EPA issues a unique registration number to each Bagging Operator. Each Bagging Operator is required to register with the EPA annually by 1 September.

The Regulations also require certain operators in the residential solid fuel supply business to register with the EPA before 31 December 2011 and every two years thereafter. Those who must register include wholesalers and retailers whose sole or main business involves the sale of bituminous coal (i.e. those with more than 50% of annual turnover from bituminous coal). There is currently no charge for registration.
Note: This requirement does not apply to the majority of general retailers for whom the sale of smoky coal is not their main business activity.
