Position Paper Regulation 27 Consultation to inform development of Draft Guidance for Brownfield soil and stone by-product material incorporating a PFAS screen
Summary: The EPA has published a position paper for consultation as part of the development of national guidance for brownfield soil and stone by-product material. The guidance will clarify where brownfield soil and stone can be used as by-product or where it must be safely disposed of. This will assist developers and environmental consultants with brownfield soil by-product notifications. The planned guidance will use pollutant limit values for the protection of human and environmental health based on use scenarios and vulnerabilities of the site. Interim ambient concentrations are being examined for use as pollutant limit values for PFAS.
The Agency is seeking stakeholder views to inform the guidance development by 5pm 15th May 2026. Please email your observations/suggestions to byproduct@epa.ie.
It should be noted that in the interests of transparency, all written submissions received may be made publicly available on the Environmental Protection Agency’s website. Receipt of submissions will be acknowledged but it will not be possible to issue individual responses.
