The collection and transport of waste, returned or recovered ozone depleting substances (refrigerant gases and halons) is controlled, to ensure environmental protection and compliance with waste law (the same requirements apply also to the collection and transport of waste, returned or recovered fluorinated greenhouse gases). A position paper on this subject has been published by the EPA and should be consulted by all operators handling such waste gases.
This means that the collection and transport of waste, returned or recovered ozone depleting substances can only be carried on by a person that meets one of the following requirements:-
Waste, returned or recovered refrigerant gases, halons and fluorinated greenhouse gases must be brought to an authorised facility i.e. a facility that has either a licence from the Environmental Protection Agency, or a Waste Facility Permit or Certificate of Registration from the relevant local authority.
The requirement for making Prior Annual Notifications to the Agency is effective since 1 June 2008. The relevant legislation is the Waste Management (Collection Permit) Regulation 2007 (S.I. No. 820 of 2007), as amended by the Waste Management (Collection Permit) (Amendment) Regulations, 2008 (S.I. No. 87 of 2008). A copy of these Regulations can be downloaded below.
Prior Annual Notifications must be made to the Environmental Protection Agency by any person intending to collect and transport waste, returned or recovered refrigerant gases, halons and fluorinated greenhouse gases in appropriate containers. Prior Annual Notifications apply to substances that are controlled by the following legislation:
Prior Annual Notifications must be submitted to the Agency using an online form. In order to submit the online Prior Annual Notification, the company must first set up an register general company details with the EPA, which is a once off step. This will allow the company to login each year to submit the Prior Annual Notification, through a Single Sign On (SSO) portal.
The online system for submission of Prior Annual Notification is known as the ODS & F-gas Compliance System Application; it is envisaged that future developments of the system will take account of additional compliance requirements related to the ODS and f-gas regulations.

A list of Prior Annual Notifications received and acknowledged by the EPA, in accordance with Article 30(1) of the Waste Management (Collection Permit) Regulations 2007, is available to download below.
