EPA Prosecutes Tipperary Co-Operative Creamery Limited, Reg No. P0801-01

On 7th July 2021 the Environmental Protection Agency prosecuted Tipperary Co-Operative Creamery Limited, Station Road, Tipperary, County Tipperary at Tipperary District Court.

Tipperary Co-Operative Creamery Limited pleaded guilty to breaches of conditions of its Industrial Emissions Licence – P0801-01 by:

  • Three charges for failure to comply with Condition 5.1 of its Industrial Emissions Licence, in that emissions to water at emission point reference SW-2 exceeded the Emission Limit Value (ELV) for Ammonia as set out in Schedule B.2 of the said licence, on or about the 26th day of September 2019, the 24th day of October 2019 and the 18th day of November 2019.

 

  • Failure to comply with Condition 5.1 of its Industrial Emissions Licence, in that emissions to water at emission point reference SW-2 exceeded the Emission Limited Value (ELV) for Biochemical Oxygen Demand (BOD) as set out in Schedule B.2 of the said licence, on or about the 18th day of November 2019.

 

  • Failure to comply with Condition 2.2.2.9 of its Industrial Emissions Licence, in that they failed to maintain a programme as required by said condition, to ensure that there was adequate control of the processes under all modes of operation, namely, control of the onsite waste water treatment plant, between on or about the 24th day of January 2020 and the 30th January 2020.

 

  • Two charges for failure to comply with Condition 5.2 of its Industrial Emissions Licence, in that emissions of odours from the activities carried on at the site resulted in an impairment of, or an interference with amenities or the environment beyond the installation boundary, on or about the 26th day of February 2020 and the 2nd day of March 2020.

 

  • Failure to comply with Condition 11.1(ii) of its Industrial Emissions Licence, in that they failed to notify the Agency of emissions which did not comply with the requirements of the said licence, between on or about the 14th day of August 2019 and the 10th September 2019.

 

Judge McGrath convicted Tipperary Co-Operative Creamery Limited on all charges and imposed fines totalling €20,000.  Agency costs totalling €18,915 were also awarded.
