EPA Prosecutes Uisce Éireann – Miltown Malbay (D0321-01)

On 29th September 2025 at Dublin Metropolitan District Court, the Environmental Protection Agency prosecuted Uisce Éireann breaches of conditions of its Waste Water Discharge Licence D0321-01 (Miltown Malbay, County Clare).
Uisce Éireann pleaded guilty to breaches of conditions by:
- Failing on or about the 5th of March 2024 to comply with the provisions of Condition 3.3, in that one or more specified discharges from the waste water works exceeded the emission limit value for Carbonaceous Biochemical Oxygen Demand (CBOD) as set out in Schedule A: Discharges and Discharge Monitoring of the said Licence.
- Failing on or about the 23rd of January 2024 to comply with the provisions of Condition 3.3, in that one or more specified discharges from the waste water works exceeded the emission limit value for Ammonia Total (as N) as set out in Schedule A: Discharges and Discharge Monitoring of the said Licence.
- Failing on or about the 5th Of November 2024 to comply with the provisions of Condition 3.3, in that one or more specified discharges from the waste water works exceeded the emission limit value for Ammonia Total (as N) as set out in Schedule A: Discharges and Discharge Monitoring of the said Licence.
- Failing on or about the 15th of May 2024 to comply with the provisions of Condition 3.3, in that one or more specified discharges from the waste water works exceeded the emission limit value for Orthophosphate (as P) as set out in Schedule A: Discharges and Discharge Monitoring of the said Licence.
- Failing on or about the 3rd of September 2024 to comply with the provisions of Condition 3.3, in that one or more specified discharges from the waste water works exceeded the emission limit value for Orthophosphate (as P) as set out in Schedule A: Discharges and Discharge Monitoring of the said Licence.
- Failing on or about the 15th of August 2024 to comply with Condition 4.16, to provide a composite sampler on all monitoring points listed in Schedule A.2: Secondary Waste Water Discharge(s) and Monitoring of the said licence, in particular secondary wastewater discharge point SW002.
Judge Halpin convicted Uisce Éireann on all charges and imposed fines totalling €12,000. Agency costs were also agreed
