Under the EU Emissions Trading System, where an operator, an aircraft operator or a shipping company does not surrender sufficient allowances by 30 September to cover its emissions in the previous calendar year, an excess emissions penalty (EEP) automatically applies. The penalty is based on a price of €100/tonne of CO2 equivalent adjusted for increases in the Harmonised Index of Consumer Prices (HICP) since 2012.
