EPA prosecutes Dawn Meats Ireland Unlimited Company (P0179-01)

Hearing Date: May 15, 2023

On 15th of May 2023, at Waterford District Court, the Environmental Protection Agency prosecuted Dawn Meats Ireland Unlimited Company (P0179-01) for breaching conditions of their IE Licence. 

 

Dawn Meats Ireland Unlimited Company (P0179-01) pleaded guilty to 25 separate charges, namely:

 

  • Failing to comply on two dates with the provisions of Condition 6.1 of the Industrial Emissions Licence (as amended) Register Number P0179-01 in that emissions to effluent discharge point EW1 exceeded the Emissions Limit Value (ELV) for Oils, Fats and Greases as set out in Schedule 1(i) of the said licence. Contrary to Section 86(6) of the Environmental Protection Act, 1992 (as amended).

 

  • Failing to comply on three dates with the provisions of Condition 6.1 of the Industrial Emissions Licence (as amended) Register Number P0179-01 in that emissions to effluent discharge point EW1 exceeded the Emissions Limit Value (ELV) for COD as set out in Schedule 1(i) of the said licence. Contrary to Section 86(6) of the Environmental Protection Act, 1992 (as amended).

 

  • Failing to comply on one date with the provisions of Condition 6.1 of the Industrial Emissions Licence (as amended) Register Number P0179-01 in that emissions to effluent discharge point EW1 exceeded the Emissions Limit Value (ELV) for BOD as set out in Schedule 1(i) of the said licence. Contrary to Section 86(6) of the Environmental Protection Act, 1992 (as amended).

 

  • Failing to comply on two dates with the provisions of Condition 6.1 of the Industrial Emissions Licence (as amended) in that emissions to effluent discharge point EW1 exceeded the Emissions Limit Value (ELV) for Suspended Solids as set out in Schedule 1(i) of the said licence. Contrary to Section 86(6) of the Environmental Protection Act, 1992 (as amended).

 

  • Failing to comply on one date  with the provisions of Condition 6.1 of the Industrial Emissions Licence (as amended) in that emissions to effluent discharge point EW1 exceeded the Emissions Limit Value (ELV) for Ammonia as set out in Schedule 1(i) of the said licence.  Contrary to Section 86(6) of the Environmental Protection Act, 1992 (as amended).

 

  • Failing to comply on seven dates with the provisions of Condition 4.1 of the Industrial Emissions Licence (as amended) in that you failed to notify the Agency as soon as practicable after an emission that did not comply with the requirements of the said licence, namely emissions to effluent discharge point EW1 which exceeded the Emissions Limit Values (ELVs) as set out in Schedule 1(i) of the said licence.  Contrary to Section 86(6) of the Environmental Protection Act, 1992 (as amended).

 

  • To supplying the Environmental Protection Agency information which was false or misleading in a material respect, namely environmental monitoring information and declarations that the information was truthful and accurate for EW-01 on six dates.  Contrary to Section 13(5)c of the Environmental Protection Act, 1992 (as amended).

 

  • Failing to comply with the provisions of Condition 2C of the Industrial Emissions Licence in that you did fail to take measures to restore compliance with Condition 6.1 of the said licence on three dates. Contrary to Section 86(6) of the Environmental Protection Act, 1992 (as amended).

 

Judge Kevin Staunton, having heard the evidence convicted and fined the company €3,000 on all 25 charges giving a total fine of €75,000 and full costs were also awarded to the Agency
