EPA prosecutes Uisce Éireann (Rathmolyon) (Reg. No. A0552-01)

On 23rd January 2023 the Environmental Protection Agency prosecuted Uisce Éireann (Rathmolyon) at Dublin Metropolitan District Court.

Uisce Éireann pleaded guilty to breaches of conditions of its Waste Water Discharge Certificate of Authorisation – A0552-01 by:

 

  • Failure to comply with Condition 3.1 on or about the 18th of January 2022 in that there were unauthorised discharges, namely the release of untreated waste water from the waste water works.

 

  • Failure, to comply with Condition 2.1, beginning on or about 1st day of November 2021 and ending on or about 18th January 2022, in that they did fail to notify the Agency, as soon as practicable following the occurrence of an incident as defined in the said Certificate, namely, the unauthorised discharge of untreated waste water. 

 

Judge Halpin, having heard the evidence, convicted Uisce Éireann on charge one above and took charge two into consideration. He imposed a fine of €500 on charge one.  Agency costs were also awarded.
